01General provisions
1.1 This AML/KYC Policy explains how NefiSwap keeps its website, Telegram bot and mini app (together, "the service") from being used for money laundering, terrorist financing, fraud and other illegal activity. It is part of our Exchange rules.
1.2 By creating an order, you accept this Policy and confirm that the funds you send belong to you and come from a lawful source.
1.3 You don't need an account to place an order. The checks in this Policy apply when an order, a transaction or a user is flagged by our security system.
1.4 We may update this Policy at any time. The version published on this page applies to every order.
02Prohibited funds and activity
2.1 You may not use the service to exchange or send funds that:
- come from or are connected to criminal activity, including fraud, theft, hacks, scams, ransomware, extortion or darknet markets;
- are linked to wallets, addresses or smart contracts on sanctions lists;
- have passed through mixers, tumblers or other services designed to hide where funds come from or to avoid AML checks;
- are meant to finance terrorism or any other illegal activity.
2.2 You may not act for another person without their knowledge, use someone else's payment details, or split an exchange into several orders to avoid limits or checks.
03Transaction screening
3.1 Every incoming transaction may be checked automatically by our security system and by blockchain analysis tools.
3.2 A link to illegal activity may be identified through our partners, public sources, complaints from affected people or requests from competent authorities.
3.3 We are not required to disclose the source or the details of the information that led to a check.
04Order suspension
4.1 If funds are reasonably suspected to be linked to illegal activity, we may suspend the order before it is completed.
4.2 When an order is suspended, we email you the order ID and the information we need. All further communication about that order takes place by email only.
4.3 Contact us from the same email address entered in the order. Requests from any other address or channel may be refused.
4.4 Information about the funds must come directly from the person who sent them. We don't accept it from third parties on their behalf.
05Source of funds
5.1 During a check, we may ask you to explain and prove where the funds came from and how you received them, for example:
- the history of the transactions that led to your deposit;
- statements or screenshots from the exchange, wallet or service the funds came from;
- documents confirming a purchase, sale, salary or other lawful income;
- an explanation of your relationship with the person or service that sent you the funds.
5.2 You confirm that all information and documents you provide are true, accurate, current and complete, and you are responsible for them.
5.3 If you refuse to provide the requested information, or the information confirms a link to illegal activity, the funds may be frozen and held for return to the affected parties through the competent authorities.
06Identity verification (KYC)
6.1 We may ask you to verify your identity when the source of funds cannot be confirmed, when you know the person suspected of the illegal activity, or when a partner requires it.
6.2 Verification may include:
- a valid government-issued photo ID;
- a selfie or a short video of you holding the ID;
- proof of address;
- additional documents about the funds.
6.3 We use verification data only for the purposes of this Policy and protect it as described in our Privacy notice.
07Results and refunds
7.1 If the check is completed successfully, we continue or refund the order as set out in the Exchange rules.
7.2 After a check, refunds are made only to the address the funds were sent from, after verification and minus network fees.
7.3 If the check confirms a link to illegal activity, the funds stay frozen and are released only at the request of a competent authority.
08Account and service restrictions
8.1 During a check, or if we suspect fraud, money laundering or other illegal activity, we may restrict your access to the service, including new orders, affiliate payouts and account features.
8.2 We may refuse service to anyone who breaks this Policy.
09Timeframes
9.1 Checks usually take 1–10 business days from the moment we receive all requested information. Complex cases can take longer.
9.2 Business days are Monday to Friday. A late reply from you extends the check.
10Records
10.1 Keep the records of your transactions and of any suspended order, and provide them when we ask.
10.2 We keep the information collected under this Policy for as long as needed for compliance purposes.
11Contact
11.1 All AML and verification matters are handled by email at [email protected]. Put your order ID in the subject line.
